But how can buyers check if a property is registered or not? Below are 3 simple and easy-to-follow steps for checking Haryana RERA registered projects; 

  1. First, go to www.haryana rera.gov.in. You will see two tabs named HARERA Gurugram and HARERA Panchkula. Select the one that suits your requirements. 
  1. Upon clicking one of the two tabs, a window containing different options, such as check payment status, projects, proceed to payment, etc., will appear. Select ‘Projects’ since you want to find out if a property is registered or not.
  1. After clicking ‘Projects,’ a new window with options, including search projects, registered projects, project status, and more, will appear. Select ‘Registered Projects,’ and a complete list of registered projects under the HARERA of your choice will appear. You can look for the specific property accordingly.

OR  

You can select ‘Search Projects,’ which will give you two options: Advanced Search and Basic Search

The latter allows you to look for a property according to a district, while the former gives you additional search options, including Builder Name and Builder district. 

Enter the builder’s name and district, click the search button, and the entire list of registered projects for the concerned builder will open.  

Apart from finding out if a property is registered with HARERA, buyers can also access other services provided by RERA Haryana through the website. In the event that a buyer uses the services of a real estate agent to buy a property, they can verify the agent’s credentials via the HARERA website to avoid becoming a victim of fraudulent activities. There is an entire list of verified and registered agents on the website that buyers can view at any time.

The last two decades have seen a property boom in India, particularly in metropolitan regions. Everyone values having a home and a personal space. There has been much discussion about huge real estate companies failing to execute projects for years, while home buyers have paid more than 80% and are still waiting for possession. 

As a result of this revelation, hundreds of people’s dreams of purchasing a home were destroyed. Unkept commitments on projects from some builders also disheartened the public and made them wary on real estate investments. All of this culminated in the introduction of a much-needed law and legal authority to oversee builders and track if the so-called real estate project is a scam in your name.

The Real Estate Regulatory Authority (RERA) Act of 2016 came into effect on May 1, 2016. Some sections took longer than others to complete, and legislators were notified on May 1, 2017. RERA is a fundamental law that establishes several standards for builders, promoters, brokers, real estate advocates, homebuyers, and others in order to provide transparency to the real estate purchase and selling process.

The following are the payment provisions of the RERA Act of 2016:

  • The rights and duties of homebuyers include making the proper payments to the builder as specified in the selling agreement.
  • The homebuyers can be obliged to pay interest if they don’t make the needed payment on time as promised.
  • The division of registration fees, municipal taxes, water and energy expenses, maintenance fees, ground rent, and other payments in accordance with the agreement is also required by the RERA new regulations 2022.
  • Until the purchasers take ownership, the builder is liable for all outgoings such as water and electricity.
  • According to RERA’s new 2022 regulations, the buyer may pay the builder no more than 10% of the total amount unless the agreement to sell is fulfilled. 

It should be noted that these restrictions are included in the center’s new RERA standards. Further criteria may be imposed by state/UT rules.

What Are The Recent HARERA  Rules Amendments?

High Court’s Decision Regarding Haryana RERA

The Punjab and Haryana High Court recommended that the owner and the proprietary company be treated as a single legal entity rather than as separate ones.

Real estate agents may be charged the same registration fee, regardless of whether they register as a proprietary firm or an individual, according to RERA Haryana. Prior to this change, there existed a cost difference between registering under the HRERA legislation as a proprietary corporation vs an individual agent.

Earlier, the HARERA has so far imposed fees of Rs 25,000 on people filing as real estate agents and Rs 2.5 lakh on “others” who listed themselves as proprietary companies. The renewal fees for individuals are Rs 5,000, while for private companies is Rs 50,000.

Following the HC judgement, the Indian real estate authorities will be required to charge agents who file as “Other than individuals,” such as proprietary companies, a standard fee. Five years after the enactment of the Real Estate Regulation Act (RERA), the much-needed law has not only developed but became the best possible version of itself. RERA, Real Estate Regulatory Authority, was introduced to bring about lucidity in the real estate sector. The main objective of the RERA Act was regulating the real estate sector and providing a formal structure for real estate buyers by addressing their concerns, queries and grievances. The act aims to minimise project delays and disintermediation as it helps buyers and builders to establish a factor of mutual trust.

The emergence of a grievance redressal system in the real estate sector was long overdue as transparency and accountability are two important factors that needed to be incorporated in the existing home buying landscape. Under this revolutionary law, the new guidelines acted as a roadmap for real estate developers and stakeholders to adhere to standardized norms and introduce the concept of credibility in business-customer relationship.

Real Estate Regulation Act

At present, it is mandatory for all builders or developers to follow RERA regulations before they launch a project. RERA is a transformative act that reassures consumers that their investment for the acquisition of a home in an under-construction project would be utilized for the completion of that particular project as per agreement. According to the RERA guidelines, builders must open an escrow account and deposit 70% of the money collected from buyers and withdraw money from the account only for buying raw material for that specific project only. Strict penalties have been prescribed in the Act (up to 10% of the project cost) for developers who violate the rules or fall short of their promises in any stage of development.

RERA has brought out reciprocal trust among the consumers and builders. It has also provided important guidelines to discipline builders who now have to provide a definitive delivery date and prompt updates on construction speed and other relevant details to the home buyers.  In order to make things simpler for home buyers, the Act also defines the exact metrics of “carpet area” so that customers know exactly what they are paying for. This law makes it obligatory for developers to post all the particulars on factors such as project plan, layout, government approvals, land title status, sub-contractors to the project, scheduled for completion with the State Real Estate Regulatory Authority (RERA) and then in effect pass this information further.

These guidelines have helped in creating a more equitable and fair-trade agreement between buyers and developers of properties as the real estate sector has subsequently witnessed increased amounts of real estate transactions in the last 5 years. With a regulatory Act designed to protect and safeguard the interests of stakeholders, RERA has significantly aided in boosting investments in the real estate sector and promoting a feeling of trustworthiness while maintaining the spirit of the home buying process.

2. Size of the Apartment – Builders generally mention the super area of the apartment which includes common areas such as staircase, lobby etc. But the carpet area of the home can turn out to be approximately 30% less than the super area. For example, if someone says that the super area of the flat is 1000 sq. ft then that includes the lobby area, staircase etc and the actual carpet area can turn out to be just 700 sq. ft.

3. Hidden Cost – While signing any kind of document or contract, one must keep their eyes open for any kind of hidden costs. Legally, the total cost of the house should be calculated by including the stamp duty as well as the registration charges.

4. Check on the Property- One must make sure that the agreement of sale is drafted as per the State’s Municipal Corporation and should have a title certificate, municipal corporation’s approvals and no objection certificate given by any authority.

5. Are Freebies Actually FREE? – Many builders claim to give you free woodwork, free maintenance charges, free parking and much more. Just double check if there is a loophole in the whole deal because it is to better to be aware than regret later.

6. Connectivity – How connected the place is to the other major parts of the city should be one thing that should be in one’s mind before buying that perfect home. The project might offer amazing amenities, low price and other things within the project, but one needs to step out of the house too. Is it really safe and easy to connect to the other parts o the area or not?

7. Security – Try and find out the latest details about the security of the area you are planning to invest in. If there are cases of regular thefts or other crimes, then beware.
